By accessing or using SproutSmart™ (the "Service"), you agree to be bound by these Terms of Service. The Service is operated by Logan Scott LLC ("we", "us", or "our").
1. Nature of the Service
SproutSmart™ provides planting schedule recommendations based on USDA Hardiness Zone data and historical climate patterns. The planting datasets, zone matrices, and scheduling algorithms that power the Service are proprietary to Logan Scott LLC and are protected by copyright.
- Informational Only: All recommendations are for informational purposes only and do not constitute professional agricultural, horticultural, or financial advice.
- No Guarantee of Results: Nature is inherently unpredictable. Local soil quality, moisture levels, unexpected frost, and other environmental factors may significantly affect gardening results. We do not guarantee a successful harvest or any specific yield.
2. Prohibited Use
To protect the integrity of the Service and our proprietary data, you agree not to:
- Attempt to gain unauthorized access to the Service's infrastructure or user accounts.
- Scrape or Crawl: Use any automated system, including "robots," "spiders," or "offline readers," to systematically extract data or content from the Service without prior written permission.
- Use the Service for any unlawful purpose or in violation of local, state, or international laws.
3. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- Security Breach: You must notify us immediately via our contact page if you believe your account has been compromised.
- Termination: We reserve the right to suspend or terminate accounts that violate these terms or compromise the security of the Service.
4. Intellectual Property
The SproutSmart name, logo, custom application code, and the specific organization of our planting datasets are the property of Logan Scott LLC.
- While individual plant facts are drawn from public sources, the arrangement and presentation of the data within the Service is protected by copyright. You may not reproduce or redistribute any part of the Service without written consent.
5. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free, nor do we make any warranty as to the results that may be obtained from the use of the planting recommendations.
6. Limitation of Liability
To the fullest extent permitted by law, Logan Scott LLC shall not be liable for any indirect, incidental, or consequential damages (including, but not limited to, loss of crops, property damage, or loss of data) arising from your use of the Service.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will update the effective date above when changes are made.
